Liability Waiver

I am the parent or guardian of the minor child or children named on the previous page. In consideration for my and each child’s participation in the Robin Hood Kids program (hereafter referred to as the “program”), I agree as follows with respect to myself and each child:

I understand that the program will involve physical activity, travel within New York City, and participation in situations beyond the immediate control of Robin Hood Foundation (“Robin Hood”).  As is the case with any physical activity, the risk of injury, even serious, disabling, or fatal, is always present and cannot be entirely eliminated.  I am voluntarily participating in and allowing my child to participate in the program. I assume all risks to myself and my child associated with the program including, but not limited to, serious and/or permanent physical injuries, death, and loss of or damage to property and equipment, which might result not only from my own or my child’s actions, inactions, or negligence, but also the actions, inactions, or negligence of others, including but not limited to Robin Hood and its directors, officers, agents, employees, other representatives, and their successors and assigns (hereafter referred to as the “releasees”).


I accept personal responsibility for the damages following such physical injury, death or property loss or damage, including but not limited to those resulting from the negligence of the releasees. I knowingly and freely assume all risks, both known and unknown, even those arising from the negligent acts or omissions of others and assume full responsibility for my own and my child’s participation.


Having read this waiver and knowing these facts, I, on behalf of my child, myself and anyone entitled to act on my or my child’s behalf, do hereby waive and release the releasees from all present and future claims and liabilities of any kind, known or unknown, arising out of my and my child’s participation in the program, whether any such claim or liability may arise out of ordinary negligence, fault or otherwise on the part of any of the releasees or others.


I acknowledge and represent that I have read this Liability Waiver, fully understand it, and sign it voluntarily as my own free act and deed; that no oral representation, statements or inducements, apart from the foregoing written agreement, have been made; that I am at least eighteen (18) year of age and fully competent; and that I execute this Liability Waiver for full, adequate and complete consideration fully intending to be bound by same.
